These Terms of Use ("Terms") are the agreement between you and FOLIANT LIMITED, a company registered at 10 Ammochostou, Apt. 201, 4187 Ypsonas, Limassol, Cyprus ("we," "us"), and they cover your use of website at foliantlimited.com ("Site"). By creating an account or using the Site, you agree to these Terms. If you don't agree, please don't use the Site.

You're also agreeing that we can send you records, notices, and future versions of these Terms electronically, and that electronic signatures are valid, where the law allows.

Using the Site

As long as you follow these Terms, we give you a personal, non-exclusive, non-transferable and revocable right to use the Site for your own, non-commercial purposes. Please don't:

• copy, change, republish or publicly show any part of the Site without our written permission;
• interfere with how the Site works technically;
• try to get around or switch off any security or access controls;
• use the Site in a way that disrupts it or blocks other people; or
• send anything unlawful, offensive or harmful through the Site.

Who owns what

Everything you see in the Site — the text, graphics, design, software and logos — belongs to us or our licensors and is protected by intellectual-property laws.

What the Site offers

The Site gives you information about, and access to, our software-as-a-service product and its subscription plans. Nothing here is a binding offer or a promise that the service will always be available. If you buy a paid plan, the checkout or billing terms shown at purchase also apply.

Your content

If you send us content, feedback or other information (a "Submission"), you're telling us that you're allowed to share it, that it's accurate, and that it doesn't include someone else's confidential information unless we've specifically asked for it under a separate agreement. You give us a free, worldwide licence to use and process your Submission to run and improve the service. We don't have to review, reply to or keep any Submission, and we can remove it whenever we like.

Your privacy

We handle your personal data as described in our Privacy Policy, which sets out what we collect, how we use it, who we share it with, and the rights you have.

No guarantees

The Site is provided "as is" and "as available," with no warranties of any kind, express or implied — including fitness for a particular purpose, merchantability, non-infringement or uninterrupted access. Some places don't allow these exclusions, so parts of this may not apply to you.

If something goes wrong

As far as the law allows, we and our people aren't liable for any indirect or knock-on losses from your use of the Site, such as lost data or reputational harm. Whatever happens, our total liability is capped at what you paid us (if anything) in the three months before the issue arose. If you paid nothing, we have no financial liability.

Ending your access

We can limit, pause or end your access to the Site at any time, with or without notice, including if you break these Terms.

The legal bits

These Terms are governed by the laws of England and Wales. If a dispute isn't settled within 30 days, it will be finally resolved by a single arbitrator under the Rules of the London Court of International Arbitration (LCIA). These Terms are the whole agreement between us about the Site, and if any part can't be enforced, the rest still applies. We may update these Terms by posting a new version in the Site; continuing to use it means you accept the changes.
